The Notification and the Immediate Challenge

The Telangana State Election Commission had set the stage for the MPTC (Mandal Parishad Territorial Constituency) and ZPTC (Zilla Parishad Territorial Constituency) elections, planning to conduct them in two phases on October 23 and October 27, 2025. However, this electoral process faced an immediate legal hurdle.

A batch of petitions was filed challenging the 42% reservations allocated for Backward Classes (BCs) in these local body elections. The core of the challenge centered on whether these reservations adhered to constitutional principles and the Supreme Court’s mandate regarding the overall cap on reservations.

State’s Defense and the Court’s Directive

During the hearing, the state’s counsel, including Advocate General A Sudarshan Reddy and senior counsel Prof Ravivarma Kumar, argued vigorously in defense of the reservation policy. They contended that the 42% reservation for BCs was based on “empirical data collected in a scientific and forensic manner,” which reportedly indicated that BCs constitute approximately 57% of the total population. Furthermore, Ravivarma Kumar highlighted that even the Supreme Court has indicated that the 50% reservation cap could be breached if supported by quantifiable data.

High Court’s Interim Stay:

Despite the state’s arguments, a division bench comprising Chief Justice Aparesh Kumar Singh and Justice GM Mohiuddin ordered an interim stay on the elections. The bench directed the state to file a counter-affidavit on the petitions within four weeks, granting the petitioners an additional two weeks to file their replies if necessary. The court also stated that “Reasons (for interim stay) will follow” and adjourned the hearing.

What This Means for Telangana’s Rural Polls

This interim stay puts the entire election schedule on hold, introducing an element of uncertainty for candidates, political parties, and the electorate. The legal proceedings will now dictate the path forward for the rural local body polls, which are crucial for grassroots democracy and local development in Telangana. All eyes will be on the High Court as it deliberates further on the complex issue of reservation policy and its implementation.
